The use of the term “Services” extends to any new hosting or digital product or related technical service added by Bloxblue, whether directly or through its partnerships or upstream providers, at any future point unless explicitly excluded by written notice or amendment to these Terms of Service.
It is understood that Bloxblue, as a sole proprietorship, operating under Indian law, does not issue GST-compliant invoices or hold any formal business registration number unless and until such status changes and is publicly announced on our official platform.
By using Bloxblue’s services, you affirm and warrant that you meet the legal requirements to enter into binding contracts under applicable Indian law and, where relevant, the laws of your own jurisdiction.
Specifically:
If you are an individual user: You represent and confirm that you are at least 18 years of age or older, or, if you are between the ages of 13 and 17, you affirm that you have obtained explicit permission from a parent or legal guardian to register for and use Bloxblue’s services.
If you are acting on behalf of an organization, company, group, or institution: You represent and warrant that you have the authority to bind the legal entity you represent to these Terms of Service, including its obligations for payments, compliance, and dispute resolution under Indian law.
If you are a minor (under 18): You must ensure that your parent or legal guardian is aware of your use of Bloxblue services and that they agree to be bound by these Terms on your behalf. Bloxblue reserves the right, at its sole discretion, to request verifiable proof of this consent at any time. Failure to provide proof of parental or guardian approval upon request may result in immediate suspension or termination of services.
You further acknowledge and agree that any misrepresentation regarding your age or authorization status, whether intentional or accidental, constitutes a breach of contract, and Bloxblue reserves the right to terminate the agreement, suspend services, or pursue legal remedies as necessary under Indian law.
Bloxblue operates in a dynamic industry where technology, laws, and customer expectations evolve rapidly. As such, we reserve the full and absolute right to revise, amend, supplement, or replace these Terms of Service at any time, for any reason, without prior individual notification, in order to reflect:
Changes in the scope or nature of the services offered.
Modifications to applicable local, national, or international laws.
Adjustments to industry best practices, security protocols, or ethical standards.
Changes arising from feedback, disputes, or incidents involving customers or regulatory bodies.
Requirements from upstream vendors or infrastructure providers that impact the terms of service delivery.
Any such modifications will be published solely and exclusively on the official Bloxblue website. The most recent version of the Terms will supersede all previous versions and will take effect immediately upon being made publicly available, unless an alternative effective date is explicitly stated within the notice of modification.
By continuing to access or use any of Bloxblue’s services after such changes have been posted, you expressly acknowledge that you have read, understood, and agreed to be bound by the modified Terms.
If you do not agree with any amendment or revision of these Terms, your sole remedy is to discontinue using Bloxblue’s services. Continued usage of services will be treated as full and unconditional acceptance of all posted changes.
Additionally, clients are advised to check the Terms of Service regularly, especially before renewing any service, placing new orders, or initiating support requests, to ensure they are aware of the current version of these Terms.
Bloxblue also reserves the right to issue supplemental policies or guidelines that further explain, modify, or clarify the application of these Terms for specific services, scenarios, or customer types. Such supplemental materials, once published on the Bloxblue website, shall carry the same binding force as these Terms.
When you create an account with Bloxblue, you agree fully and without exception to submit truthful, accurate, complete, and current information during the account registration process and throughout your ongoing relationship with us. This includes, but is not limited to:
Your legal full name or, if registering as an entity, the official or trading name of the organization.
A valid, monitored email address that you have direct access to.
A working phone number where you or your legal representative can be reached for urgent communication.
Accurate billing information including payment method and, where applicable, geographic location.
By registering for an account, you acknowledge that this information is used to verify your identity, communicate critical service announcements, resolve disputes, process payments, and comply with lawful requests from authorities. If any part of your information changes, including your name, email, payment credentials, or country of residence, you are required to update your account details without undue delay through the official Bloxblue client portal.
Failure to maintain accurate and updated information may result in service disruption, suspension, or permanent termination of your account at Bloxblue’s sole discretion. Additionally, any disputes or payment issues arising from inaccurate account information will be your sole responsibility, and Bloxblue will not bear any liability for the consequences of outdated, false, or misleading data you have provided.
You are solely and entirely responsible for maintaining the confidentiality, integrity, and security of all account credentials associated with your Bloxblue account. This includes, but is not limited to, your username, password, two-factor authentication (2FA) tokens, recovery codes, and security question answers.
You agree that you will not share your login credentials or access rights with any unauthorized individual, group, or entity under any circumstances. You further acknowledge that you will not allow third parties to use your account, intentionally or accidentally, and that you are fully accountable for any activity, authorized or unauthorized, that takes place under your account credentials.
Bloxblue advises all users to follow security best practices, including:
Using strong, unique passwords that are not reused on other websites or services.
Enabling two-factor authentication (2FA) where available.
Updating passwords immediately if you suspect any compromise.
Logging out from all devices when using public or shared computers.
You understand and agree that your account credentials represent your digital signature within Bloxblue’s systems, and any action performed using your account will be presumed to have been performed by you, whether or not you authorized it.
Bloxblue will take reasonable measures to secure its systems against unauthorized access or malicious intrusion; however, the security of your specific account is your individual responsibility. You acknowledge and accept that Bloxblue shall not be held liable directly or indirectly for any financial loss, service disruption, data compromise, reputation damage, or any other consequential or incidental harm arising from unauthorized access to your account due to:
Your failure to secure your login credentials.
Negligent sharing or disclosure of access details.
Insecure personal computing practices, such as using outdated or compromised software.
Third-party breaches affecting your email, payment processor, or device security.
This limitation of liability remains in effect even if the unauthorized access is discovered after the fact, and it is your obligation to take preventative security measures appropriate to the sensitivity of your hosted data and services.
If you have reason to believe that your Bloxblue account has been compromised in any way whether through unauthorized logins, suspicious transactions, unfamiliar changes in configuration, or service anomalies, you are required to notify Bloxblue immediately via the official support portal or designated email address (support@bloxblue.com).
Prompt notification enables Bloxblue to implement protective measures, investigate the nature and scope of the suspected breach, and assist in account recovery. Failure to report suspected security issues in a timely fashion may result in the loss of access to services, data loss, or additional liability for any damages caused to Bloxblue, its infrastructure, or other clients.
You acknowledge that failure to report a breach not only endangers your own data but may create risk for other Bloxblue users, and this responsibility cannot be waived, delegated, or ignored.
If you are under the legal age of 18, but older than 13, you may only register for and use Bloxblue’s services if you have the full, explicit, and informed consent of your parent or legal guardian.
This consent must cover:
Agreement to these Terms of Service.
Understanding of service fees and payment obligations.
Awareness of data storage and security risks.
Acceptance of liability for misuse of services.
Bloxblue reserves the right to request written proof of parental or guardian consent at any time for accounts registered by minors. Accounts found to be in violation of this requirement are subject to immediate suspension or termination, with or without prior notice.
If you are a parent or legal guardian and you permit your child to use Bloxblue’s services, you are fully responsible for supervising their usage and are bound by these Terms as though you were the account holder.
Maintaining accurate and current contact and payment information is not optional but a fundamental obligation of every Bloxblue user. This ensures:
Timely delivery of service renewal reminders and invoices.
Notification of changes to services, pricing, or Terms of Service.
Security alerts, technical notices, and account recovery assistance.
Receipt of important communications concerning your legal rights, obligations, or disputes.
You agree to promptly update your contact email, billing method, and any other relevant information through the Bloxblue client portal whenever changes occur. Failure to do so may result in:
Missed payment reminders and subsequent service suspension or termination.
Inability to recover your account in case of lost credentials.
Disruption in service provisioning and technical support.
Bloxblue disclaims responsibility for any service disruptions, penalties, or additional fees arising from your failure to update this information.
Bloxblue’s services, including but not limited to game hosting, Minecraft server hosting, VPS (Virtual Private Server), VDS (Virtual Dedicated Server), and Discord bot hosting, are provided to all users strictly on an “as-is” and “as-available” basis.
This means Bloxblue does not provide, either expressly or implicitly, any warranties, guarantees, or assurances regarding the availability, performance, fitness for a specific purpose, accuracy, or reliability of the services offered.
You understand and agree that:
The services may experience interruptions, delays, errors, or failures due to various factors, including system maintenance, technical malfunctions, network congestion, external cyberattacks, or force majeure events.
Bloxblue does not guarantee that the services will be free from defects, viruses, security vulnerabilities, or any form of external or internal disruption.
No oral or written advice, technical assistance, or customer support interaction, regardless of source, creates any warranty not explicitly stated in these Terms.
Bloxblue is not liable for any loss, damage, or inconvenience arising from service downtime or reduced performance, whether planned or unplanned.
As a client of Bloxblue, you are strictly prohibited from engaging in any form of unlawful, unethical, or malicious behavior while using our services. The following activities are explicitly forbidden, but the list is not exhaustive:
Distribution of Malware, Viruses, or Ransomware: You may not use Bloxblue’s servers or network to distribute, develop, host, or facilitate the transmission of any form of malicious software, including but not limited to viruses, spyware, keyloggers, trojans, worms, and ransomware.
Hosting or Sharing Illegal Content: This includes, but is not limited to, the storage, distribution, or facilitation of:
Child sexual abuse material (CSAM) or child pornography.
Pirated or unauthorized software.
Counterfeit products or intellectual property infringing materials.
Content that violates national or international criminal statutes.
Network Attacks and DDoS (Distributed Denial of Service): Launching, controlling, coordinating, or participating in any cyberattacks, DDoS incidents, or other malicious interference with networks, systems, or services, whether targeted at Bloxblue or external entities is prohibited.
Spam, Unsolicited Advertisements, and Bulk Mailing: Using Bloxblue’s services to send spam, unsolicited commercial advertisements, phishing content, or large-scale bulk email campaigns, even if the recipient has not opted out, is strictly forbidden.
Hacking, Cracking, and Unauthorized Access: Engaging in, promoting, or facilitating attempts to bypass security systems, exploit software or hardware vulnerabilities, crack passwords, or intrude into private systems without authorization is not allowed.
Violations of this section may result in immediate and permanent suspension or termination of services without notice, and Bloxblue reserves the right to report such activities to relevant legal authorities for investigation.
To ensure the integrity and lawful use of its infrastructure, Bloxblue reserves the right, at its sole discretion, to monitor service usage. This may include monitoring network traffic, server logs, and user interactions when necessary to:
Detect and prevent misuse.
Investigate security incidents.
Comply with legal requirements.
Maintain service performance and stability for all clients.
Should any violation of these Terms be detected, Bloxblue retains the absolute right to suspend or terminate the offending user’s services, with or without prior warning, and no liability for service interruption, financial loss, or data destruction will be assumed.
As a condition of using Bloxblue’s services, you agree to ensure that your activities and the content you host or distribute fully comply with all applicable local, state, national, and international laws, regulations, and guidelines.
This applies regardless of your country of residence or operational base and includes compliance with:
Indian Information Technology Act, 2000.
Copyright and intellectual property laws.
Cybersecurity frameworks.
Export and trade restrictions.
Data protection regulations, both domestic and international.
Bloxblue disclaims all liability for the actions of users that violate applicable laws and will cooperate with lawful requests for user data when legally compelled to do so by competent authorities.
Bloxblue reserves the right to impose limits or take corrective action, including suspension, throttling, or termination of services, where user activity:
Causes network instability or degradation.
Negatively affects the performance or reliability of infrastructure.
Disrupts the services of other clients on the shared or dedicated hosting environment.
Creates any real or perceived security threats to the Bloxblue network or its clients.
These protections are critical to maintaining a safe, fair, and efficient hosting environment for all users.
You agree not to use Bloxblue services for the storage, sharing, or distribution of content that violates intellectual property rights, including but not limited to:
Copyrighted materials, such as software, music, video, books, and code, without appropriate licensing or permission.
Trademarks, logos, or other brand assets belonging to third parties without consent.
Patented inventions, processes, or designs reproduced or distributed without authorization.
It is your responsibility to verify the legal status of any material hosted on Bloxblue infrastructure. Bloxblue will act on any formal notice of copyright or intellectual property violation under applicable law.
While Bloxblue may implement reasonable measures for data integrity and system stability, the primary responsibility for preserving, maintaining, and backing up your data lies with you.
You agree to:
Regularly maintain independent backups of all your hosted files, configurations, databases, and data.
Ensure that backups are securely stored outside of Bloxblue's infrastructure.
Understand that Bloxblue is not obligated to restore, recover, or guarantee the retrieval of any lost or corrupted data under any circumstances.
Service interruptions, hardware failure, or cyberattacks may result in permanent data loss, for which Bloxblue assumes no liability.
To ensure equitable access to server and network resources for all clients, Bloxblue may enforce technical limits on:
Bandwidth consumption.
Central Processing Unit (CPU) utilization.
Random Access Memory (RAM) usage.
Disk space/storage capacity.
These limits may be defined in your chosen hosting plan, and exceeding them may trigger automatic resource throttling, suspension of the affected service, or termination of your account if misuse is severe or repeated.
Bloxblue reserves the right to adjust resource allocation policies as required to maintain infrastructure integrity.
If your use of Bloxblue services results in excessive resource consumption, service degradation, or disruption for other clients, Bloxblue reserves the right, without prior notice, to:
Temporarily suspend the service.
Permanently terminate the service.
Impose usage restrictions or upgrade requirements.
This applies regardless of whether the excessive usage was intentional or accidental. You acknowledge that Bloxblue is the sole arbiter in determining what constitutes excessive or disruptive use based on its technical assessment.
When you use Bloxblue’s services, including but not limited to game hosting, Minecraft server hosting, VPS, VDS, and Discord bot hosting, you are solely and fully responsible for any content that you upload, transmit, distribute, display, execute, or store on Bloxblue’s infrastructure.
You explicitly agree not to upload, store, host, distribute, or share any content or material that:
Violates Applicable Laws or Regulations: Content must fully comply with all laws, rules, and regulations that apply within India, your country of residence, and internationally, including but not limited to intellectual property laws, anti-terrorism laws, child protection legislation, privacy and data security laws, and cybercrime statutes.
Infringes on Third-Party Intellectual Property Rights: Content that unlawfully uses, replicates, reproduces, distributes, or modifies copyrighted works, trademarks, trade secrets, patents, or any other proprietary or intellectual property belonging to a third party is strictly prohibited unless you have obtained the necessary permissions or licenses from the rightful owner.
Contains Obscenity, Hate Speech, Violence, or Defamation: Hosting or disseminating material that contains offensive or abusive content including but not limited to content that promotes hatred, incites violence against individuals or groups, spreads misinformation, slanders individuals or businesses, or features obscene or sexually explicit material in violation of applicable decency standards is not allowed under any circumstances.
Promotes Terrorism, Extremism, or Illegal Activities: Content that promotes, glorifies, encourages, or facilitates any form of terrorist activity, extremist ideology, organized criminal conduct, or otherwise illegal actions including recruitment, funding, planning, or incitement is forbidden on Bloxblue’s infrastructure.
Violation of these conditions will result in immediate service suspension or termination without refund, and where applicable, legal authorities may be contacted.
Bloxblue reserves the unconditional right, at its sole discretion, to:
Inspect, monitor, audit, or review any content hosted or transmitted through its network or servers.
Remove or disable access to content that is found to violate these Terms, applicable laws, or any rights of third parties, including intellectual property, data privacy, or defamation claims.
Block, suspend, or terminate accounts that persistently or egregiously violate content policies.
Bloxblue undertakes this right as part of its good faith efforts to maintain a safe, ethical, and law-abiding hosting environment, though this does not imply any obligation to proactively monitor or moderate all content.
You acknowledge that Bloxblue is not obligated to pre-screen content and that you are solely responsible for ensuring all material on your account complies with applicable laws and these Terms.
In the event of a content-related investigation or compliance audit, whether initiated internally by Bloxblue or externally by law enforcement or other authorities, you agree to fully cooperate and:
Provide accurate and complete information as requested.
Facilitate access to relevant files, logs, and configurations.
Assist Bloxblue in clarifying any issues that arise during the audit.
Remove or modify any content that Bloxblue identifies as violating these Terms or applicable laws, upon request and within a reasonable timeframe.
Failure to cooperate or delays in addressing such matters may result in the suspension or termination of your service without prior warning.
Failure to comply with content removal requests, audit participation, or any part of these Terms will be deemed a material breach of this agreement.
In such cases, Bloxblue reserves the right to:
Immediately suspend or terminate your services without notice or refund.
Restrict your ability to create new accounts or access future services.
Report the incident to appropriate legal or regulatory authorities when necessary.
Pursue further legal remedies to protect its interests and the interests of other clients.
Bloxblue assumes no liability for damages, direct or indirect, resulting from the suspension or termination of services due to non-compliance with content policies.
Bloxblue reserves the right to retain server logs, usage data, and copies of suspicious or non-compliant content as part of its responsibility to:
Maintain system security and integrity.
Prevent abuse or criminal activity.
Comply with legitimate legal and regulatory requests from competent authorities, including but not limited to Indian law enforcement agencies and international cybercrime units.
You acknowledge and agree that Bloxblue may, at its discretion or when legally compelled, disclose your data, contact information, logs, and hosted content to governmental or regulatory bodies without prior notice to you, if such disclosure is necessary to investigate suspected criminal or illegal activities or to comply with applicable laws.
This provision remains enforceable even after the termination of your service agreement.
As part of its ongoing commitment to maintaining a secure, reliable, and up-to-date service offering, Bloxblue, an India-based, a sole proprietorship business under Indian law reserves the unrestricted right to modify, enhance, upgrade, patch, or otherwise alter its hosting services, platform features, technical environments, and infrastructure at any time. This right applies to all service categories offered by Bloxblue, including but not limited to:
Game Hosting,
Minecraft Server Hosting,
Virtual Private Servers (VPS),
Virtual Dedicated Servers (VDS),
Discord Bot Hosting,
Custom or specialty hosting products.
Such modifications may be driven by a variety of technical or legal factors, including but not limited to:
Compliance with updated industry standards, security protocols, or best practices.
Responding to newly discovered software vulnerabilities or system flaws.
Hardware lifecycle upgrades and deprecation.
Performance optimization and efficiency improvements.
Introduction of new features or discontinuation of obsolete ones.
Adjustments required by upstream providers, vendors, or regulatory authorities.
You acknowledge and agree that Bloxblue is under no obligation to notify clients individually or collectively prior to implementing such modifications. These modifications may occur automatically and without advance warning, at Bloxblue’s sole discretion.
By purchasing and using any of Bloxblue’s services, you expressly acknowledge and accept that the delivery of web hosting, game server hosting, VPS, VDS, or bot hosting is inherently dependent on ongoing maintenance, hardware upgrades, software patches, and platform changes.
Such service modifications may:
Cause temporary interruptions in the availability, stability, or performance of your services.
Result in short-term loss of access to hosted files, game servers, VPS instances, websites, or other hosted content.
Require server reboots, migration to new physical or virtual environments, or short notice downtime.
While Bloxblue endeavours to minimize disruption and to schedule non-urgent updates during low-traffic hours, when possible, you understand that not all updates can be announced in advance or scheduled to accommodate individual client needs.
You agree that Bloxblue shall not be held liable for any direct or indirect losses, damages, or business disruptions including but not limited to financial losses, reputation harm, client dissatisfaction, or missed deadlines that result from service interruptions caused by these necessary updates or modifications.
Certain upgrades or service modifications may require direct action, intervention, or manual configuration changes by the client. Examples include but are not limited to:
Adjusting server-side scripts or software to ensure compatibility with upgraded system libraries or programming languages (such as Java versions, PHP, Node.js, or Python).
Updating DNS records or server endpoint configurations following a server migration or IP address reassignment.
Reinstalling, reconfiguring, or adapting client-deployed software, game mods, plugins, or applications that are no longer compatible after an update.
Adopting revised security best practices, such as regenerating API keys, passwords, or SSL certificates when underlying security infrastructure is updated.
In such cases, Bloxblue will make commercially reasonable efforts to communicate technical guidance or instructions via appropriate channels, including but not limited to:
Knowledge base articles on the Bloxblue website.
Notification through the client support portal.
Direct email communication to the client’s registered contact email.
You agree to promptly review and follow any guidance issued by Bloxblue for such updates, and you acknowledge that your failure to act upon such guidance may result in reduced service quality, compatibility issues, or service downtime for which Bloxblue is not responsible.
Bloxblue is not responsible for performing software adjustments, data recovery, or troubleshooting on client-managed software or third-party applications installed on your hosting environment, unless such support is explicitly covered under a separately purchased support or managed service agreement.
These Terms of Service, including any future modifications, extensions, or amendments, as well as any disputes, claims, controversies, or disagreements that may arise directly or indirectly from the use of Bloxblue’s services, shall be strictly governed by and construed exclusively in accordance with the prevailing laws of the Republic of India. This governing law applies without regard to any principles of conflict of laws, choice of law doctrines, or any other legal theory that might otherwise cause the laws of another jurisdiction to apply.
By registering for and using Bloxblue’s services including but not limited to game hosting, Minecraft server hosting, VPS, VDS, Discord bot hosting, and any related hosting or technical services you expressly acknowledge, agree, and accept that any legal matters, concerns, claims, or proceedings that may arise out of or relate to these Terms, your service agreement, your user relationship with Bloxblue, or any business conducted with Bloxblue, will be subject to the exclusive jurisdiction and venue of the courts located within the sovereign territory of India.
You further agree that you will not attempt to initiate or transfer legal proceedings to any court, tribunal, or legal authority outside of India under any circumstances. By accepting these Terms, you expressly waive the right to contest jurisdiction or venue for any matter related to your use of Bloxblue’s services.
In the event that you or Bloxblue believe a dispute, controversy, or disagreement has arisen that relates to these Terms of Service, the use of services, payment obligations, or any other matter under the client-provider relationship, both parties agree to make all reasonable efforts to resolve the dispute amicably through direct communication and informal negotiation. This includes but is not limited to written communications, email discussions, and structured dialogue with the goal of reaching a fair and efficient resolution without resorting to legal proceedings.
Should the parties fail to resolve the dispute through these informal means within a reasonable period of time, which shall not exceed thirty (30) calendar days from the initial written notice of the dispute, both parties agree that the matter shall be referred exclusively to arbitration in accordance with the provisions outlined under the Arbitration and Conciliation Act, 1996 as amended from time to time.
The arbitration process shall meet the following conditions:
Location: The arbitration shall be conducted exclusively in West Bengal, India.
Language: The arbitration proceedings shall be conducted entirely in the English, Bengali and Hindi language.
Arbitrator: The arbitrator shall be mutually appointed by both parties, or in the absence of agreement, appointed in accordance with the procedures outlined in the Arbitration and Conciliation Act, 1996.
Finality: The arbitrator's decision shall be final, binding, and enforceable in any court of competent jurisdiction, and both parties agree to comply fully with the arbitrator’s award without delay.
You expressly waive the right to pursue any legal remedy in court for any matter that has been agreed to be settled by arbitration, except where required for the enforcement of the arbitrator’s decision.
You agree that if for any reason a dispute or legal action related to these Terms of Service cannot be resolved through the arbitration process outlined above, such legal action or proceeding will be filed, maintained, and adjudicated exclusively in the courts located within the territorial jurisdiction of India.
By using Bloxblue’s services, you voluntarily consent to the personal jurisdiction of the courts located within India and agree not to raise any objection regarding:
The jurisdiction of such courts,
The venue or geographical location of the legal proceedings,
Any claims of forum non conveniens (inconvenient forum).
You agree that you shall not initiate any legal proceedings or file lawsuits related to Bloxblue’s services or these Terms of Service outside the Republic of India under any circumstances.
In the event that any provision, clause, or part of these Terms of Service is determined by an Indian court of competent jurisdiction or by an arbitrator to be unlawful, invalid, unenforceable, or void, such determination shall not affect the validity or enforceability of any remaining provisions of these Terms of Service.
The unaffected portions of the Terms shall remain in full force and effect, and the invalidated provision shall be severed from the Terms without altering the meaning or intent of the remaining provisions.
Where possible, the invalid, illegal, or unenforceable provision will be replaced by a valid and enforceable provision that achieves, as closely as possible, the same effect, commercial purpose, and meaning as the original clause.
When a client initiates an order for any of the services offered by Bloxblue including, but not limited to, Game Hosting, Minecraft Hosting, Virtual Private Servers (VPS), Virtual Dedicated Servers (VDS), Discord Bot Hosting, and any related or supplementary hosting solutions an invoice corresponding to the order is automatically generated by the system. The client acknowledges and agrees that the full payment of this invoice is a mandatory prerequisite for service provisioning.
No hosting services, server access, or technical resources will be provisioned, allocated, or made accessible until the full invoiced amount has been received by Bloxblue, successfully processed, and confirmed as paid in full. Partial payments, payment commitments, or payment receipts that are pending verification do not entitle the client to access services, and no exceptions will be granted unless otherwise confirmed in writing by Bloxblue.
Bloxblue reserves the absolute and non-negotiable right to modify, adjust, increase, or decrease the pricing of its services at any point in time at its sole discretion, for any reason deemed appropriate by Bloxblue, including but not limited to operational cost increases, inflation adjustments, supplier or upstream vendor cost changes, or currency fluctuation considerations.
For clients with existing active services, Bloxblue will make reasonable efforts to provide no less than seven (7) days' advance notice prior to the implementation of any price adjustment. Such notification may be delivered via email, the client area portal, or published via an official notice on the Bloxblue website. The client acknowledges that continued use of the services after the effective date of the price adjustment constitutes an unconditional agreement to the new rates.
All payments for services rendered by Bloxblue are due on or before the due date specified on the invoice. Clients are solely responsible for ensuring timely payment. Failure to remit payment by the stipulated due date may result in the immediate suspension or permanent termination of the associated services, without further notice, grace period, or warning.
Bloxblue is under no obligation to issue any prior notification before suspending or terminating services for overdue payments. Clients agree that service suspension or termination due to non-payment does not relieve them of the responsibility to settle any outstanding balances. Reactivation of services, if offered, may require full payment of the overdue balance, including applicable late fees, and is subject to Bloxblue’s approval.
If a client opts into the automatic renewal feature for any recurring service, they grant Bloxblue explicit and ongoing authorization to initiate and process payment transactions using the client’s saved payment method for each billing cycle without seeking further approval or confirmation from the client for each renewal.
This authorization shall remain valid until the client manually disables automatic renewal via the billing portal or submits a written request for cancellation and the service term ends accordingly. The client is responsible for ensuring that their selected payment method remains valid and has sufficient funds to process automatic renewals to prevent service disruption.
The client is solely responsible for managing any active subscriptions or recurring payment mandates set up through third-party payment processors, including but not limited to credit/debit cards, PayPal, Razorpay, or UPI-linked accounts.
Bloxblue will not be held liable for unintended charges or recurring payments that arise due to the client’s failure to cancel or update their payment subscription settings with the relevant payment processor. Clients must verify that subscriptions are canceled properly before discontinuing service to avoid unintended billing.
Bloxblue reserves the unrestricted and unconditional right to suspend or permanently terminate any client’s service account at its sole discretion in the event of a confirmed or suspected violation of these Terms of Service, the Acceptable Use Policy (AUP), or any other policy published on the Bloxblue website. Such action may be taken without prior warning, advance notice, or an opportunity for remedy, depending on the severity of the violation.
Clients acknowledge that Bloxblue is not obligated to justify or explain the grounds for suspension or termination beyond referencing the applicable violated policy.
In the event of suspension or termination of a client’s service, whether initiated by Bloxblue or the client, all hosted data, files, configurations, scripts, backups, and other associated digital materials stored on Bloxblue’s servers may become permanently inaccessible.
Bloxblue does not guarantee the recovery or retention of any client data after suspension or termination of the service, and the client assumes full responsibility for maintaining independent backups of all data prior to such an event. The client waives any claim against Bloxblue for data loss or corruption arising from service termination.
Bloxblue may permanently terminate client services without prior notice or compensation for any of the following reasons, including but not limited to:
Non-payment: Failure to pay invoices by the stipulated due date.
Acceptable Use Policy Violations: Engaging in behavior that violates Bloxblue’s Acceptable Use Policy, including but not limited to illegal content hosting, abusive practices, and resource misuse.
Legal Compliance Demands: Receipt of an official directive, order, or request from a recognized law enforcement agency, regulatory body, or court that mandates service termination.
Third-Party Abuse Complaints: Receipt of verified abuse reports or credible complaints from third-party sources, including Internet service providers, security organizations, or affected individuals, regarding misuse or misconduct originating from the client’s hosted services.
The client acknowledges that Bloxblue’s determination of whether grounds for termination exist will be final and binding.
Either the client or Bloxblue may terminate an active service arrangement at any time by submitting a formal cancellation request via email or the client area. The cancellation becomes effective only after acknowledgment and confirmation by Bloxblue.
Termination of services by either party does not release the client from any financial obligations incurred prior to the effective date of termination. Any outstanding invoices, fees, or charges must be settled in full, even after the account or service is closed.
Upon termination of any service or account, Bloxblue reserves the right to permanently delete all client data, including but not limited to files, configurations, databases, backups, and associated records stored on its servers.
The client acknowledges that Bloxblue is under no obligation to retain or provide copies of deleted data after termination and agrees to hold Bloxblue harmless from any loss, inconvenience, or liability caused by the deletion of such data.
The client expressly acknowledges and agrees that the services provided by Bloxblue including, but not limited to, Game Hosting, Minecraft Hosting, Virtual Private Servers (VPS), Virtual Dedicated Servers (VDS), Discord Bot Hosting, and any supplementary or ancillary services are delivered on an "as-is" and "as-available" basis. Bloxblue makes no guarantees or warranties, express or implied, regarding the performance, stability, uptime, or fitness of its services for any specific purpose.
Bloxblue shall not be held liable under any legal theory, whether in contract, tort, negligence, strict liability, or otherwise, for:
Direct, indirect, incidental, special, punitive, or consequential damages including but not limited to loss of profits, revenue, goodwill, business opportunities, or expected savings, even if Bloxblue has been advised of the possibility of such damages.
Data loss arising from service outages, system crashes, hardware or software failures, malicious attacks, accidental deletion, or operational errors. The client is solely responsible for maintaining adequate and up-to-date data backups.
Financial or reputational damage including but not limited to harm caused by downtime, service disruptions, degraded performance, or termination of services, whether caused by planned maintenance, unexpected outages, technical failure, force majeure, or actions taken by Bloxblue in compliance with these Terms of Service.
Notwithstanding any other provision contained within these Terms of Service, the total cumulative liability of Bloxblue, its owners, partners, officers, employees, contractors, and affiliates for any claim arising out of or relating to the provision of services, whether in contract, tort, warranty, or otherwise, shall under no circumstances exceed the total amount paid by the client to Bloxblue during the six (6) months immediately preceding the event that gave rise to the liability.
This limitation of liability applies regardless of the nature of the claim and shall remain enforceable even in cases where the client’s remedies fail in their essential purpose.
By entering into this agreement and using Bloxblue’s services, the client agrees to fully indemnify, defend, and hold harmless Bloxblue, its owners, affiliates, directors, officers, employees, contractors, agents, licensors, and partners from and against any and all claims, demands, disputes, actions, proceedings, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees and court costs) that arise out of or are related to:
The client’s violation of these Terms of Service or any other agreement or policy published by Bloxblue.
The client’s use or misuse of the services provided by Bloxblue, including any content hosted, transmitted, or distributed through Bloxblue’s network or servers.
Any breach of law, regulation, or third-party rights, including but not limited to intellectual property infringement, defamation, privacy violations, or unauthorized access.
The client’s indemnification obligations are binding and extend to cover all actions or omissions by the client, their authorized users, representatives, or any individual who accesses Bloxblue’s services using the client’s credentials or systems.
The client acknowledges and agrees that their indemnification obligations as outlined in Section 10.1 will survive the termination or expiration of this agreement, and the discontinuation of services. Even after the client ceases to use the services or their account is closed, the client remains legally responsible for indemnifying Bloxblue for any claims or liabilities arising from actions or circumstances that occurred during their period of service use.
Bloxblue provides customer support exclusively through its official, ticket-based support system, which is accessible via the client area or other designated platforms communicated on Bloxblue’s website. Clients acknowledge that only queries, issues, or concerns submitted through this system are eligible for review, processing, and response by Bloxblue’s support team.
Any inquiries or requests for assistance submitted via informal channels including but not limited to social media, instant messaging, phone calls, or unsolicited emails are not guaranteed a response, resolution, or acknowledgment.
Bloxblue’s customer support services are limited to assisting clients with the following categories of issues and inquiries:
Technical Issues: Troubleshooting connectivity problems, service deployment errors, server-related faults, or misconfigurations directly related to the core infrastructure or services provided by Bloxblue.
Billing Inquiries: Addressing questions related to invoices, payments, subscription renewals, overcharges, payment disputes, or transaction history.
General Service Questions: Providing guidance and information concerning the services offered by Bloxblue, service specifications, and acceptable use conditions.
Bloxblue makes no commitment to providing technical advice, support, or education beyond the direct scope of its hosting and server services.
Bloxblue’s technical support obligations do not extend to the installation, configuration, maintenance, troubleshooting, or repair of third-party software, applications, tools, or services that are deployed or used by the client on servers provided by Bloxblue.
The client is solely responsible for the setup, security, compatibility, and functionality of third-party applications and must rely on the original developers or vendors of such third-party software for product-specific support.
Bloxblue’s staff may, at their discretion, offer general advice on common software configurations; however, such guidance is provided "as-is" and without warranty or liability.
By registering for and using the services offered by Bloxblue which include but are not limited to Game Hosting, Minecraft Hosting, Virtual Private Servers (VPS), Virtual Dedicated Servers (VDS), and Discord Bot Hosting, you hereby provide your explicit consent to receive electronic communications from Bloxblue. Such communications will primarily be related to your service account and may include, but are not limited to:
System-generated invoices and billing notifications.
Service-related announcements, including updates, planned maintenance, or scheduled outages.
Security notifications, such as alerts concerning unauthorized access, system vulnerabilities, or account-related incidents.
These communications form an essential part of the service relationship between you (the client) and Bloxblue, and opting out of them is not possible for the duration of your active service.
Bloxblue will conduct all formal communications exclusively through the following channels:
The primary contact email address you provide during the account registration process, or any updated email address you supply afterward through your account settings.
The Bloxblue support portal, accessible via the client area, which serves as the centralized platform for submitting and managing support tickets, billing questions, and technical issues.
The client is responsible for maintaining accurate and functional contact information at all times. Bloxblue will not be held responsible for any missed communications resulting from outdated or incorrect client contact details.
All forms of communication exchanged between the client and Bloxblue, including but not limited to emails, support tickets, private messages, and phone conversations, are considered strictly confidential unless:
Disclosure is explicitly authorized by both parties in writing.
Disclosure is required to comply with legal or regulatory obligations, including but not limited to court orders, subpoenas, or lawful requests from law enforcement agencies.
Bloxblue is committed to maintaining the confidentiality and integrity of client communications in accordance with applicable Indian laws and international best practices, to the fullest extent possible.
Bloxblue respects and values the privacy of its clients and is committed to handling all personal and service-related data with care, transparency, and in accordance with applicable data protection principles. The terms governing the collection, processing, usage, storage, and protection of personal data are fully detailed in Bloxblue’s Privacy Policy, which is published separately on the official website.
By agreeing to these Terms of Service, the client confirms they have read and understood Bloxblue’s Privacy Policy.
By continuing to use Bloxblue’s services, you consent to the collection, use, and storage of your data as outlined in the Privacy Policy. Bloxblue may collect information necessary for billing, account management, technical troubleshooting, and compliance with legal requirements. You acknowledge that your data may be stored on servers located in India or abroad, depending on the infrastructure used, and that such storage may be subject to different legal jurisdictions.
Bloxblue utilizes reasonable, industry-standard technical and administrative measures to protect client data against accidental loss, theft, misuse, and unauthorized access. These measures include but are not limited to:
Encrypted storage of sensitive data.
Secure server configurations.
Regular software patching and maintenance.
Role-based access control for internal personnel.
However, Bloxblue makes no absolute guarantee or warranty against unauthorized access, data breaches, service interruptions, or cyber-attacks, and shall not be held liable for damages resulting from such incidents, whether caused by third parties, force majeure, or system vulnerabilities.
The client is solely responsible for maintaining their own data backups and securing their hosted content and applications against potential threats.
These Terms of Service, together with Bloxblue’s Privacy Policy, Refund Policy, Acceptable Use Policy (AUP), and Service Level Agreement (SLA), collectively represent the entire and exclusive legal agreement between you, the client, and Bloxblue concerning the provision of services. These documents supersede all prior discussions, representations, understandings, or agreements whether oral or written relating to the subject matter herein.
Any modification or waiver of these Terms must be done in writing and agreed upon by both parties to be legally binding.
The failure of Bloxblue to enforce any particular provision or condition of these Terms of Service at any time shall not be interpreted as a waiver of Bloxblue’s right to enforce such provision at a later date. Any waiver or modification of the Terms must be explicitly acknowledged in writing by an authorized representative of Bloxblue.
You, as the client, may not assign, transfer, sublicense, or delegate your rights and obligations under these Terms of Service to any third party without obtaining prior written consent from Bloxblue. Any unauthorized assignment or transfer shall be deemed null and void.
Bloxblue, on the other hand, reserves the right to assign or transfer its rights and obligations to affiliated companies, successors, or in the event of a business merger or sale, without requiring the client’s consent, provided that the transfer does not negatively affect the client’s rights under this agreement.
